These Terms of Service (“Terms”) govern your access to and use of kinpova.com, customer accounts, online checkout, product listings, order services, and related services provided by Kinpova Garment LLC. By accessing the website, creating an account, submitting an order, or otherwise using our services, you agree to these Terms and to any additional policies referenced here.

2. Our Store and Products
Kinpova Garment LLC operates an online store focused on apparel and related general merchandise. Product categories may include trousers, dresses, shorts, underwear, T-shirts, outerwear, fashion basics, and other merchandise made available from time to time. We may serve retail customers, wholesale buyers, distributors, and international customers where shipping, payment, and product availability allow.
Product descriptions, images, specifications, colors, sizes, materials, packaging, and other details are provided to help customers evaluate an item. Because displays, production batches, photography, and supplier specifications can vary, minor differences may occur where legally permissible and where the essential nature of the product is not materially changed.
3. Eligibility to Purchase
By placing an order, you represent that you are legally capable of entering into the transaction, that the information you provide is accurate, and that you are authorized to use the payment method submitted. If you place an order on behalf of a company or organization, you represent that you have authority to act for that entity.
4. Customer Accounts
If account registration is available, you are responsible for keeping your account information current and for protecting your login credentials. You are responsible for activity that occurs through your account unless prohibited by law. Please contact us promptly if you believe your account has been accessed without authorization.
5. Product Availability
All products are subject to availability. Placement of an item in a shopping cart does not reserve inventory. An order may be subject to stock verification after checkout, especially for larger quantities, wholesale orders, mixed assortments, or items that require sourcing. If an item becomes unavailable, we may contact you about a substitute, revised delivery schedule, partial fulfillment, or refund, as appropriate.
6. Prices and Currency
Unless otherwise stated, prices on kinpova.com are displayed in U.S. Dollars (USD). Product prices, discounts, shipping charges, taxes, duties, and other charges may vary based on the order and destination. The checkout page will display charges available to be calculated at that stage. For wholesale, special-order, or negotiated transactions, written quotation terms may apply instead of standard website pricing.
7. Taxes, Duties, and Import Charges
Applicable sales tax may be collected where required. For international deliveries, customs duties, import taxes, brokerage charges, or local fees may be imposed by the destination country or carrier. Unless expressly stated otherwise in the order terms, those charges are the responsibility of the recipient and are not included in the product price.
8. Orders and Order Acceptance
Submitting an order is a request to purchase. We may review an order for stock availability, payment authorization, shipping feasibility, fraud indicators, pricing errors, or incomplete information before final fulfillment. We may decline, hold, or cancel an order for legitimate reasons including suspected fraud, unauthorized payment activity, material pricing errors, inventory problems, prohibited destinations, incomplete customer information, or security concerns.
9. Payment
Available payment methods are shown during checkout. Where enabled, payments may be processed through third-party providers such as Stripe and PayPal. Customers must use payment methods they are legally authorized to use. Payment providers may apply their own terms, verification procedures, fraud controls, and processing rules.
Do not send us your online banking password, PayPal password, Stripe account password, or other payment-account login credentials. We will never need those passwords to process a normal order.
10. Payment Authorization and Fraud Review
Orders may be subject to automated or manual payment and fraud-prevention review. We may request reasonable additional information to confirm an order or shipping destination. If payment authorization fails, is reversed, or cannot be verified, we may delay or cancel fulfillment.
11. Order Confirmation
After checkout you may receive an electronic confirmation or order number. An automated confirmation acknowledges receipt of the order request but does not prevent reasonable review for payment, inventory, fraud, shipping, or pricing issues before fulfillment.
12. Shipping and Delivery
Shipping methods, estimated delivery information, and charges may be displayed during checkout or confirmed separately for larger commercial orders. Delivery estimates are not guarantees unless expressly stated in writing. Carrier delays, customs processing, weather, address issues, peak-season volume, and other circumstances outside our reasonable control can affect delivery time.
Customers are responsible for providing a complete and accurate shipping address. If you notice an address error, contact us as quickly as possible. Changes may not be possible after an order has entered fulfillment or been transferred to the carrier.
13. Risk of Loss and Delivery Issues
Where permitted by applicable law, responsibility for an order may pass according to the shipping method, carrier terms, and applicable consumer law. If tracking shows a delivery problem, package damage, or suspected loss, contact us promptly so that we can review available carrier information and help determine the appropriate next step.
14. Returns and Refunds
Return and refund eligibility is governed by our published Refund Policy and any additional order-specific terms. Returned items may need to be unused, unworn, unwashed, and in original condition with packaging or tags, except where a return concerns a verified defect, shipment error, or rights that cannot legally be excluded.
Wholesale, customized, private-label, specially sourced, clearance, hygiene-sensitive, or large-volume orders may be subject to separate return conditions disclosed before purchase.
15. Order Cancellation
We will make reasonable efforts to accommodate cancellation requests received before an order enters fulfillment or shipment. Once processing, customization, sourcing, or carrier handoff has begun, cancellation may no longer be possible. If an order has already shipped, the standard return process may apply where eligible.
16. Damaged, Defective, Missing, or Incorrect Items
If an order arrives damaged, defective, incomplete, or materially different from what was ordered, contact us promptly and include the order number, a clear description of the issue, and photographs where useful. We may request reasonable evidence to help us verify the problem and determine whether replacement, refund, partial refund, or another solution is appropriate.
17. Wholesale and Commercial Orders
Wholesale, distributor, mixed-assortment, private-label, sourcing, or high-quantity orders may require separate quotations, invoices, specifications, minimum quantities, lead times, deposits, packaging instructions, shipping arrangements, or other commercial terms. Where written commercial terms conflict with these general Terms for a specific transaction, the written terms agreed for that transaction will control to the extent of the conflict.
18. Product Specifications and Sourcing
For volume orders, customers should confirm important specifications such as size ratios, color, fabric composition, measurements, packaging, labeling, quantity, and delivery requirements before production or final shipment. We may communicate reasonable production or sourcing tolerances where relevant to a commercial order.
19. Promotions and Discount Codes
Promotions, discount codes, coupons, special pricing, and limited-time offers may have separate conditions, expiration dates, product exclusions, quantity limits, or restrictions on combination with other offers. We may correct obvious technical errors in promotional pricing where permitted by law.
20. Reviews and User Content
If the website allows reviews, ratings, comments, photos, or other submissions, you must submit content that is lawful and that you have the right to provide. Content must not be fraudulent, misleading, defamatory, threatening, abusive, infringing, malicious, or unrelated to the relevant product or service. You may use the website for legitimate browsing, account management, inquiries, and purchasing. You may not use the website to commit fraud, test stolen payment credentials, make unauthorized transactions, scrape or attack the website in a way that disrupts service, upload malicious code, impersonate another person, interfere with security controls, abuse promotions or refunds, infringe intellectual-property rights, or violate applicable law.

Attempts to bypass authentication, gain unauthorized access, interfere with checkout, manipulate prices, exploit vulnerabilities, or disrupt website availability are prohibited. We do not guarantee uninterrupted access at all times.
27. Disclaimer of Warranties

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded or limited. Product-specific warranties, if any, will be stated separately.
28. Limitation of Liability
To the fullest extent permitted by applicable law, Kinpova Garment LLC will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the website, delays outside our reasonable control, or third-party services outside our control. This limitation does not apply where liability cannot legally be limited or excluded.
29. Indemnity for Unlawful Use
To the extent permitted by law, a user may be responsible for losses or claims arising from that user's fraudulent, unlawful, or unauthorized use of the website, violation of another person's rights, or intentional interference with our systems. Before starting formal proceedings, we encourage customers to contact us with the order number and a clear description of the issue so that we can attempt to resolve the matter directly. Nothing in this section prevents a customer from using rights or procedures that cannot legally be waived.
33. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law, and the affected provision will be interpreted as closely as possible to its lawful purpose.
34. No Waiver
If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce it later.
